Fiduciary Law Explained

Fiduciary law focuses on the management of property and affairs during life or after death. It combines elements of contract, property, estate and tax law. As a result, individuals or their families often need specialized experience to protect and allocate assets.

Categories of Estate Law

Estate Planning

Throughout your life, you create a legacy that will be left behind for your loved ones. Whether your estate is big or small, Roman & Boock vows to craft a plan that will protect your hard-earned assets and allocate them accordingly.

Our trust and estate attorneys take an individualized approach to planning — devising a collection of documents tailored to you and your family’s unique needs. Your estate plan may include the following documents:

  • Last Will and Testament
  • Living Trust
  • Durable Power of Attorney
  • Healthcare Power of Attorney
  • Irrevocable Life Insurance Trust
  • Special Needs Trust
  • Lifetime Giving Plan

Probate Administration

When a person dies unexpectedly, an estate may need to be opened in the probate court to transfer the title of the decedent’s assets to heirs or beneficiaries. During probate administration, a personal representative is appointed for the estate, who then collects and distributes assets and resolves any claims against the estate.

Roman & Boock’s probate attorneys specialize in probate law. We will provide you with the assistance you need — whether that means aiding with estate administration, explaining your rights or protecting your interests in the estate.

Trust Administration

Many different challenges may arise during the administration of a trust — leading beneficiaries and trustees to seek legal counsel. Roman & Boock has handled countless issues involving trusts. We help you achieve your desired results by assisting with:

  • Provision Interpretations
  • Trustee Resignations
  • Trustee Appointments
  • Trust Accounting Preparations
  • Trust Terminations
  • Information Requests
  • Trust Term Modification

Guardianships & Conservatorships

Sometimes, a person is unable to handle their affairs. This may be because they are a minor or incapacitated — in either case, the court may appoint a guardian or conservator on their behalf.

  • A guardian is appointed for a minor child whose parents cannot provide them with care or for persons whose mental or physical state prevents them from appropriate self-care.
  • A conservator is appointed when a person is incapable of handling their financial affairs. A conservator is often required when a minor receives a large sum of money or a person is mentally incapacitated to the point where they cannot understand or manage finances.

Roman & Boock frequently handle matters relating to guardianships and conservatorships. Our conservatorship lawyers will help you navigate the court system to appoint, remove or terminate a guardianship/conservatorship or update outlined restrictions/freedoms.
